Options for Lot Owners

Listed below are Options for Lot Owners who will not use their burial space.  Decisions must be approved by all lot owners (or all heirs).

Authorization for Interment:

  • Gives another individual the right of interment and the right to place a bronze memorial
  • This does not convey ownership. No new deed is issued.
  • This Authorization can be revoked by the grantee at any time.
  • Can be completed through Memory Gardens office. There is a processing fee

Offer Back to Memory Gardens for Repurchase:

  • If no burials have occurred in your lot, you may offer your space back to Memory Gardens for repurchase.
  • A written request from all lot owners (or all heirs) must be submitted stating the garden, lot, and spaces and reason for the request. Or use form Request to Offer Lot for Repurchase or to Sell or Transfer to a Third Party. All requests must be notarized and sent by registered or certified mail.
  • Memory Gardens is under no obligation to repurchase cemetery property

Sell or Transfer to Third Party:

If no burials have occurred in your lot, property must first be offered back to Memory Gardens. A written request from all lot owners (or all heirs) must be submitted stating the garden, lot, and spaces, and the reason for the request. Or use form Request to Offer Lot for Repurchase or to Sell or Transfer to a Third Party.  All requests must be notarized and sent by registered or certified mail. If Memory Gardens declines to purchase the space, it can then be sold or transferred to a third party.

  • Sale price is agreed upon by lot owner and purchaser.  The sale is completed by both parties.
  • After the sale is completed, the current lot owner will complete an Application to Transfer Cemetery Property Form which is available from Memory Gardens.
  • The Application to Transfer Cemetery Property form, plus a check payable to Memory Gardens to issue a new deed for the new owner(s), and the lot owner’s original deed is sent to Memory Gardens. 
  • The new owner(s) will receive a new deed and ownership is completely transferred.

Donate to Memory Gardens or another Not-for-profit organization:

  •  There is a possible deduction from your yearly taxes based on the value of your spaces at today's price.
  • There is a processing fee payable to Memory Gardens after transfer is approved
  • Ownership is completely transferred; the new owner will receive a deed or in the case of a donation to Memory Gardens, property is returned to Memory Gardens Inventory

Regarding Bronze Markers:

  • No credit is given for bronze markers.
  • Markers that have been placed can be removed to be scrapped, picked up, or shipped. There is a fee for this service.
  • Markers in storage may be scrapped or picked up at no cost. They can be shipped for a fee.
